General information on data processing

On this website personal data of the users are only collected and used as far as this is necessary for the provision of a functional website as well as the offered contents and services.

Personal data is information that can be individually assigned to you. This includes, for example, your name, e-mail address, home address, gender, date of birth, telephone number or age. Non-personal data is information such as the number of users of a website.

Processing means any operation or set of operations performed with or without the aid of automated processes relating to personal data such as collection, recording, organization, arrangement, storage, adaptation or alteration, retrieval, retrieval, use, disclosure by transmission, dissemination or otherwise making available, alignment or linking, limitation, erasure or destruction.

Personal information is collected through this website when you choose to provide it, for example, by filling out forms such as the contact form. This data is used for the purposes specified in each case or resulting from the enquiry, i.e. for example your e-mail address to answer your contact enquiry. Data will only be transmitted to third parties if this is expressly permitted by law or if you have consented to such transmission in the course of an active business relationship. In addition, you can use the general information on this website without disclosing your personal data.

Legal basis for the processing of personal data

The collection and use of personal data of the users takes place regularly only after consent of the user. If the consent of the person concerned is obtained for the processing of personal data, Art. 6 para. 1 lit. a) DSGVO is the legal basis. An exception applies in those cases in which prior consent cannot be obtained for actual reasons and the processing of the data is permitted by statutory provisions. Art. 6 para. 1 lit. b) DSGVO is the legal basis for the processing of personal data required for the performance of a contract to which the data subject is a party. This also applies to processing operations which are necessary for the implementation of pre-contractual measures.

Insofar as the processing of personal data is necessary to fulfil a legal obligation to which we are subject, Art. 6 para. 1 lit. c) DSGVO is the legal basis. If the processing is necessary to safeguard a legitimate interest and if the interests, fundamental rights and fundamental freedoms of the data subject do not outweigh the first interest, Art. 6 para. 1 lit. f) DSGVO is the legal basis.

Storage period

Your personal data will be deleted as soon as the respective purpose for processing has been achieved or subsequently cancelled, unless there are further legal obligations for processing.

In addition, personal data required for the assertion, exercise or defence of legal claims will be stored. These data will be deleted at the latest when the statute of limitations (usually 3 years) applies.

Informational use of the website

You can visit this website without providing any personal information. If you use this website for informational purposes only, i.e. do not provide any personal information about yourself, no personal data will be processed by you, with the exception of data transmitted by your browser to enable you to visit the website. For the purpose of technically providing this Site, it is necessary that certain automatically submitted information be processed by you so that your browser can view this Site and you can use the Site. • Contact form

If you make use of the opportunity to send us enquiries using our contact form, we will process your name and e-mail address. You can also enter your individual message in the message field. You are free to decide whether you wish to provide us with this information. Without this information, however, we will not be able to fulfil your request to contact you, or to do so in full. When using the contact form, your personal data will not be passed on to third parties.

The data processing described above for the purpose of establishing and processing contact takes place in accordance with Art. 6 Para. 1 lit. b) or f) DSGVO.

Processing of personal data in the context of a client/order relationship (business contact)

We process personal data which we receive from you directly in connection with our contractual relationship, for example within the framework of an enquiry and the specific mandate/order placement as well as for the provision of our services. These regularly include, for example, contact and address data, records of business transactions and correspondence with you.

The data processing is carried out for the purpose of carrying out and processing all processes which concern the responsible person, clients, interested parties, business partners or other contractual or pre-contractual relationships between the aforementioned groups or legal obligations of the responsible person.

The processing of your personal data for this purpose is based on Art. 6 para. 1 lit. b) DSGVO.

Whistleblower system and whistleblowing hotline

On behalf of our contractual partners, we provide whistle blowing hotlines as external service providers. These are understood to be offers made by companies to their employees, for example, to report to the company any non-compliant conduct of other employees. As part of the services provided by our law firm, we offer whistleblowing services as an external ombudsman.

Data processing within the framework of whistleblowing hotlines is carried out for the purpose of detecting and investigating criminal offences and employee behaviour that does not conform to the rules. The processing of personal data for this purpose is based on Art. 88 Para. 1 DSGVO, § 26 Para. 1 S. 2 BDSG in conjunction with the obligation of the company/client under Art. 6 Para. 1 lit. c) DSGVO in conjunction with Art. 6 Para. 1 S. 2 BDSG. § Section 91 (2) AktG, Section 130 OWiG (compliance obligation incl. whistleblowing system). In addition to the possibility for affected persons to contact us by telephone, affected persons can also contact us via an online application. For this purpose, we use the messenger tool of the provider Signal Messer LLC, 650 Castro Street, Suite 120-233 Mountain View, CA 94041, USA. Further information can be found under "External service providers" and at https://signal.org/legal/

The personal data will be deleted as soon as the purpose for the storage no longer applies, i.e. in particular if during the proceedings it becomes apparent that the suspicion is not justified and generally after the investigations have been completed.

Passing on your personal data to third parties

A transmission of your personal data does not take place in principle. Your personal data will only be passed on to third parties or otherwise transmitted if

  • we are legally obliged to do so on the basis of official or court orders.
  • we are entitled to do so, e.g. because this is necessary to prosecute criminal offences or to exercise and enforce our rights, or
  • if you have previously consented.

Cookies

  • Use of cookies/usage profile

We use so-called "cookies" (small text files with configuration information). Cookies are small text files that are sent from our web server to your browser during your visit to our website and are stored on your computer for later retrieval. We only use so-called session cookies (also referred to as temporary cookies), i.e. cookies that are temporarily stored exclusively for the duration of your use of one of our Internet pages. The cookies used serve, in particular, to determine the frequency of use and the number of users of our websites and to continue to identify your computer during a visit to our website when changing from one of our websites to another of our websites and to be able to determine the end of your visit. This tells us which areas of our websites and which other websites our users have visited. However, this usage data does not allow any conclusions to be drawn about the user. All this anonymously collected usage data is not merged with your personal data and is deleted immediately after the end of the statistical evaluation. After the end of the session, as soon as you end your browser session, the cookies are deleted.

Most browsers are preset to accept cookies automatically. However, you can deactivate the storage of cookies or set your browser so that it notifies you before cookies are stored. Users who do not accept cookies may not be able to access or fully access certain areas of our websites.

  • Legal basis

The legal basis for the processing of the above data processing operations is Art. 6 para. 1 lit. f) DSGVO. We have a legitimate interest in presenting you with a website that stores your personal settings and makes it easier for you to visit our website. It is therefore important that we learn how we can optimise our website by using different cookies.

  • Configuration of browser settings

Most browsers are preset to accept cookies by default. However, you can configure your browser so that it only accepts certain cookies or no cookies at all. You can also delete the cookies already stored in your browser via your browser settings. It is also possible to set your browser so that it notifies you before cookies are stored. Since the different browsers may differ in their respective modes of operation, we ask you to use the respective help menu of your browser for the configuration options. If you would like a comprehensive overview of all third-party access to your Internet browser, we recommend that you install specially developed plug-ins.

Tracking and analysis tools

We use tracking and analysis tools to ensure continuous optimization and design of our website to meet your needs. With the help of tracking measures it is also possible for us to statistically record the use of our website by visitors and to further develop our online offer for you with the help of the knowledge gained thereby. Due to these interests, the use of the tracking and analysis tools described below is justified pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO. The following description of the tracking and analysis tools also shows the respective processing purposes and the data processed.

  • Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (hereinafter "Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by these cookies, such as the time, place and frequency of your use of this website, is generally transmitted to a Google server in the United States and stored there. When Google Analytics is used, it cannot be ruled out that the cookies set by Google Analytics may collect other personal data in addition to the IP address. Please note that Google may transfer this information to third parties where required to do so by law, or where such information is processed by other parties on Google's behalf.

The information generated by cookies will be used by Google on our behalf to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not merged with other data from Google according to Google's own specifications. You can generally prevent the storage of cookies by setting your browser software accordingly. However, we would like to point out that in this case you may not be able to use all the functions of our website to their full extent.

It cannot be ruled out that the cookies set by Google Analytics may collect other personal data in addition to the IP address. To prevent information about your use of the website from being collected by Google Analytics and transmitted to Google Analytics, you can download and install a plugin for your browser under the following link:

http://tools.google.com/dlpage/gaoptout?hl=de

This plugin prevents information about your visit to the website from being transmitted to Google Analytics. This plugin does not prevent any other analysis. Please note that you cannot use the browser plug-in described above when visiting our website via the browser of a mobile device (smartphone or tablet). When using a mobile device, you can prevent Google Analytics from collecting your usage data by clicking on the following link:

Disable Google Analytics

By clicking on this link, a so-called opt-out cookie is placed in your browser. This prevents information about your visit to the website from being transmitted to Google Analytics. Please note that the opt-out cookie is only valid for this browser and only for this domain. If you delete the cookies in this browser, the opt-out cookie will also be deleted. To further prevent Google Analytics from collecting cookies, you must click on the link again. The use of the opt-out cookie is also possible as an alternative to the above plug-in when using the browser on your computer.

To ensure the best possible protection of your personal data, Google Analytics has added the code "anonymizeIp" to this website. This code has the effect that the last 8 bits of the IP addresses are deleted and your IP address is thus recorded anonymously (so-called IP masking). Your IP address is generally shortened by Google before it is transmitted within member states of the European Union or in other signatory states to the Agreement on the European Economic Area and is thus made anonymous. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. This website uses Google Analytics reports in addition to demographic features, which use data from interest-related advertising by Google and visitor data from third parties (e.g. age, gender and interests). This information is not personally identifiable and can be deactivated at any time via ad preferences.

We also use Google Analytics to evaluate data from AdWords for statistical purposes. If you do not wish this to happen, you can deactivate it using the Ad Preferences Manager at https://www.google.de/ads/preferences.

  • Google Fonts

We use Google Fonts from Google LLC, Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland on our website.

Google Fonts is used without authentication and no cookies are sent to the Google Fonts API. If you have an account with Google, none of your Google Account information will be transmitted to Google while using Google Fonts. Google only records the use of CSS and the fonts used and stores this information securely. You can find out more about these and other questions at https://developers.google.com/fonts/faq?tid=231553674760=231553674760 .

You can find out which data is collected by Google and what this data is used for at https://www.google.com/intl/de/policies/privacy/ .

The service providers process the data exclusively within the framework of our instructions and are obliged to comply with the applicable data protection regulations. All contract processors have been carefully selected and only receive access to your data to the extent and for the period required that is necessary for the provision of the services or to the extent to which you have consented to data processing and use. Service providers in countries such as the United States or countries outside the European Union and the European Economic Area are subject to data protection that does not generally protect personal data to the same extent as is the case in member states of the European Union. If your data is processed in a country which does not have a recognised high level of data protection such as the European Union, we ensure that your personal data is adequately protected by contractual regulations or other recognised instruments.
